So from what level would that be legal? Level 2?

The reason it is not legal at level 1 is because there is not a required spotter for the prep-level stunt. Since level 2 does not require a spotter for prep-level stunts, this should be legal at level 2. As with any skill, though, the only official ruling can come from sending a video to the official USASF email (please send me a pm if you need the email address).
