At one time it was. There was an amazing woman who ran it and taught me so much. She and her family made it what it was. When she passed it was so sad and this person is not a Madonna.

So they need to put her on their senior coed 4 since that appears to be the only one she is eligible for age-wise (if I'm reading their bzzzz correctly ;) )

so based on the info in this thread i went nancy drew and tried to figure out who we were talking about, was so proud of myself until i looked at the name, then just felt stupid for not picking that up right away... :rolleyes:

As to that I don't know what they have. But of that is all that is there then yes.

I had a bunch of my girls get sued for leaving a gym and coming to mine. They signed a contract before the season started (basically at tryouts) stating that myself and someone else was going to be their coach. Tryouts happened, teams were made, the day of the first practice, I was handed a do not compete contract that was so limited it practice wouldn't let me say Cheerleading without their permission. I asked to have it amended and got fired. The other coach who was the program director went in to talk to the owners about getting me my job back. Two hours before the first practice of the summer started, they fired her with no reason and brought in two new coaches. The girls found out when they walked into practice and walked out. They sighted their reason for quitting was that it was a bait and switch. Come tryout for two coaches with this track record....but actually be coached by two coaches who have never been in all stars.
They were sued for the entire seasons tuition. My girls won because the judge said you cannot sue for services not rendered. This gym had a track record of suing everyone for tuition when they left. Even girls on their gymnastics team who were injured and where medically sidelined for the rest of the season. Luckily we had a athlete who's mother is a lawyer, and we had gotten a new judge. So I would check on the wording on the contract. Does it say they have to pay for tuition if they leave, or is the cancellation fee equal to the amount of tuition left for the season?

This is what I am trying to understand - were they going to stay when they thought she was on a jr 3 illegally? Is it the fact that she is now on a jr 1 that has made them upset and they are now throwing in the age issue as a way of calling out the gym? I'm actually not kidding.

honestly... it would suck for your niece, but if there's no way to get her off the team without legal action, someone may need to use her as the "sacrificial lamb" and call them out after they step off the mat at the first competition.
(or as a result of this thread, you may have inspired some other gyms to call her gym/team out anyway)
I'm with @CheerBank though - I'm just not fully understanding the situation. if she had signed a contract prior to team placements, fine. but it sounds like she signed a contract after her daughter was placed on an illegal team - basically saying that it was perfectly okay with her or she wouldn't have signed it. only when they moved her down multiple levels did it become an issue for her? or did i miss something?

According to my sister in law, she is on another state from me, we moved. As I was saying she doesn't keep up with age groups or even what is needed for what level. All I knew was she was cheering for this gym. So I get a call and she said that her daughter and said my niece was upset because she was removed from a level 3 team to a level 1. She asked me why and what was the difference because she signed a contract and was told no matter what she had to pay. When I asked why she told me then I found out she was on a jr team. I am the one who pointed out she couldn't be on that team because of age. Don't get me wrong, as a parent you should know all rules, or maybe that is just me. I have known other parents of new to all star athletes who didn't know nor care about knowing the rules. This is her second yr and last yr she just let me handle it.

A parent doesn't need to know all of the rules, but they should know what questions to ask. I am sorry she is stuck in this position. Hopefully, the gym will see that she should not be on a junior level team at all. Honestly, what can the USASF do?

That is true, she should have known, but we as gym owners should be held accountable. That is a very good question, what can they do? That's why I posted this. Has this happened and been made aware in the past?
