After Summit last season we left our gym. The rings are now in and the owner is refusing to give my daughter her ring as there is a dispute over an unpaid balance. She is saying we owe money we don't. Is this ethical? Does she own this ring? Regardless of any financial issues the child won the ring with her teammates. Opinions?
 
Who paid for the ring and have you actually sat down with the owner to see where the payment discrepancy is?


The ring is something she won. Not something we had to pay extra for. And yes
 
I heard of a situation where this happened over a jacket. The women was never able to get the jacket for her daughter.

Hmm, I guess if you didn't pay all comps fees they (the gym) can say they own the ring. Yes, your cp did win first place but the gym might try to tell you that if you didn't pay all comp fees the ring isn't yours.
It isn't fair to your cp but I'm sure the gym can get away with it :(

Short answer is yes, IMO.
 
Agree with others, yes the gym can do that.

Hopefully you have receipts or bank statements to prove all money paid vs what they say was collected.

It is. The rings are not free and they are paid for; if the gym owner believes you owe money, she can legally and ethically keep it.
 
I would get in writing exactly what is owed - the amount and for what. If you are sure your account is up to date, you should be able to provide credit card or check records for the disputed amount. If you paid in cash and did not get a receipt unfortunately you are SOL.
 
I'm not a lawyer, but I am fairly certain that the gym legally can't withhold the ring if you can prove your child was on the mat as a registered athlete. I think any small claims court would rule in your favor. The gym could then file a counter claim if they feel you own them money for services rendered (tuition, comp fees, uniform, etc) and if you can't prove that you paid the amounts due, the court would rule the counter claim in favor of the gym.
Ethically is another story. I would never withhold a ring from an athlete regardless if I was owed money. The athlete would get his/her ring and I'd find the most ruthless collections company I could find and deal with the parent directly :D

Sadly there are quite a few coaches/owners out there who would be thrilled to withhold an athlete's ring if that athlete left their gym for another one.
 
We can't answer that question, only you can deal with the coach and the situation
