King is absolutely right. Method Man has said in numerous interviews that his daughter is a cheerleader and he goes to her competitions. There is no way he could go to a comp and not hear either his own music, or someone he is friends with's music. Same thing with Miley Cyrus or the Kardashians or any other celebrities involved in cheer. It is not worth their time to have a legal team look into all the legalities associated with cheer music production. As the cheer community grows I'm sure it is only a matter of time before some musician/producer/writer goes to a competition and wonders why someone else is making money on their work.

While that sounds nice and lovely, the reality is practically no artist has complete control of their music. Record companies exist for a reason and they are the ones who tend to make the most profit. Even if a musician doesn't care, doesn't mean their label doesn't. Does that make sense? Some musicians have more say so, but def not all of them.

So hypothetically a music company could sue a large competition for large amounts (millions?), and then what? NCA or Cheersport or Jamfest is done and out of business?

Answer in it's simplest form... yes. Unless these competitions have license rights to all the music used, they could technically be sued for using and profiting from the use. As well as the DVD companies that make the DVD's sold at the competitions!!

But as others have said, the music industry as a whole would be biting their nose to spite their face if they ever did sue, despite the fact they could sue and win. It wouldn't be worth the money they would walk with in the face of an entire industry of young girls and boys who would never buy one of their albums again because they shut down their industry!!

Let's put it this way... the day that the record industry sues a major competition company or DVD company is the day we will have much more to worry about... we'll probably be in line to board the next train to the FEMA camps.

It's all about how easy it is to do and if someone has the interest. If each music producer does 200 mixes a year... and there is 20 music producers... 4,000 cases a year? I am sure there is ways to bundle them but also include the bad publicity. It's not that it can't happen, it is just that someone would have to have a bug up their butt kinda motivation.

I think it is more of a reality and closer than people think. If you remember several years ago I remember you posting that Disney had contacted you asking for you to remove the pictures of gym’s world shirts that had an image or likeness to Disney on it. If I also remember they advised that any shirt they saw would be confiscated and not allowed into the complex?

It will not take much for the music industry to file a cease and desist, knowing full well that the cheer world does not have deep pockets and no one would be able to fight the lawsuit and that will be the day the music dies, cheer music that is. I can see some type of agreement or “use” fee being charged to satisfy both parties similar to what YouTube does.

No I know they can eventually come after us. But I think we survive by the krill strategy. They can't get us all!

I kinda agree with this. Remember all the negative publicity the RIAA took for suing kids who downloaded stuff off of Kazaa a few years ago? It would have that air of "going after the little guy", and the record labels can't afford that kind of negative press right now.

I heard the RIAA is looking into cheer music, I can't find a source link to this but I've seen it discussed several places. Anyone have a link?

I guess this doesn't surprise me after reading how companies like Time Warner, Verizon and some other cable providers have agreed to work with the RIAA and MPAA.

Or you could do the legal thing and pay them (the RIAA, etc) for the rights to use their songs.


Hmmmm maybe I should go into the cheer music business since my dad has the authorization for most music/artists... Lol but the problem of playing it in a venue I'm not so sure about. I think that would be the EP's responsibility at that point bc they're playing it and technically "profiting" from it (indirectly like some ppl on YouTube)
